EURO SCHOOL OF TENNIS
WAIVER OF LIABILITY, ASSUMPTION OF RISK, INDEMNITY AND CONVENIENCE FEE AGREEMENT
In consideration for permitting Participant to receive tennis instruction and participate in all related activities, including, but not limited to, use of Euro School of Tennis’s premises and facilities, and in addition to any monetary compensation required by Euro School of Tennis, the undersigned, for themselves, and for their respective heirs, personal representatives and assigns, agree as follows:
Assumption of Risk. The undersigned hereby acknowledge that TENNIS IS A SPORT, WHICH CARRIES INHERENT RISK OF INJURY AND DAMAGE TO THEIR PERSON AND PROPERTY. The specific risks of injury to person vary from one activity to another, but the risks range from (1) minor injuries such as scratches, bruises, and sprains; (2) major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, and concussions; and (3) catastrophic injuries including paralysis and death. THE UNDERSIGNED KNOWINGLY ASSUME ANY AND ALL RISKS OF BODILY INJURY, DEATH OR PROPERTY DAMAGE, WHETHER THOSE RISKS ARE KNOWN OR UNKNOWN, STEMMING FROM THEIR PARTICIPATION IN EUROPEAN SCHOOL OF TENNIS’S TENNIS INSTRUCTION PROGRAM AND ALL RELATED ACTIVITIES.
Release and Waiver: The undersigned hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE the European School of Tennis, its agents, and employees (collectively, the “Releasees”), from and for any liability resulting from any personal injury, accident or illness (including death), and/or property loss, however caused, arising from, or in any way related to, Participant’s participation in the tennis instruction program and all related activities, except for those caused by the willful misconduct, gross negligence or intentional torts of the above parties.
Indemnification and Hold Harmless: The undersigned also hereby agree to INDEMNIFY AND HOLD the Releasees HARMLESS from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities including, but not limited to, attorney’s fees, arising from, or in any way related to, Participant’s participation in European School of Tennis’s tennis instruction program and all related activities, except for those arising out of the willful misconduct, gross negligence or intentional torts of the above parties.
Permission to Use Likeness: The undersigned further agree to allow, without compensation, Participant’s likeness to appear, and to otherwise be used, in material, regardless of media form, promoting the European School of Tennis, and/or its events and activities.
Severability: The undersigned further expressly agree that the foregoing waiver of liability, assumption of risk, and indemnity agreement is intended to be as broad and inclusive as is permitted by the law of the State of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
Acknowledgment of Understanding: I have read this waiver of liability, assumption of risk, and indemnity agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
If Signed by Parent or Guardian:
I verify that the dangers of the activities and the significance of this waiver of liability, assumption of risk, and indemnification agreement were explained to the Participant and that the Participant understood them.
Consent to Treatment of a Minor: In the event of sudden illness, accident or injury which may occur while Participant is engaged in any activity supervised by any Releasee, when neither the parent nor the guardian can be contacted, I hereby give my consent pursuant to California Family Code Section No. 6910 for emergency medical treatment. In the event of urgency according to the circumstances medical treatment may be given by any doctor licensed under the laws of the State of California.
Cancellation Policy: All cancellations must be submitted no later than 24 hours prior to the first meeting of the program.
If you cancel your program within:
2 or more weeks prior to the starting date: 75% refund
1-2 weeks prior to the starting date: 50% refund
24 hours or less than 1 week prior to the starting date: 25% refund
Less than 24 hours prior to the starting date: all fees will be forfeited.
If the participant has a medical condition cancellation will be handled on an individual basis depending on the situation. A medical note will be required for our review. An administration fee of $30 apply may apply to all cancellation requests.
Make Up Policy: We regret to inform that we do not offer any make-ups or refunds for missed days for reasons other than severe weather If you have any special circumstances please contact us at least 24 hours before the scheduled class via email: info@euroschooloftennis.com.
Convenience Fee: There is a non-refundable 3% convenience fee when you purchase with a Credit Card. Alternative payment methods are available: contact us for more details via email: info@euroschooloftennis.com
Coach Requests: A student may request a certain tennis coach, however we can not guarantee their availability to teach. While we strive to have consistent schedule for the coaches their schedules vary and may change at any time during the session. In the event of a coach change or absence, a qualified coach will always be assigned for your program.
